General Terms

The General Terms section describes rules applicable to all users and visitors of eescreen.com website and service. By accessing or using eescreen.com website you agree to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

The materials contained in this website are protected by applicable copyright and trademark law.

Summary

We use your information only for functional use and for our own marketing usage.
You are personally responsible for your account. Do not share it.
Advertisers are in a business relationship with Screen owners, not with us. We only provide the platform.
You are responsible for your User Content. You remain any legal rights of the User Content, but you grant us permission to use it.
As a screen owner, you are also responsible for the content you approve to your screen. Approve only content that you are sure to be appropriate.
We do not warrant the service and therefore not liable for any problems.

Privacy

Your personal privacy is important to us. Our service collects and uses your data only for functional purposes and our own marketing use. Your information is not shared to anyone outside our company, except for service functionality, like the payment process.

Account

For owning your own eeScreen or buying advertisements, you need to create your own account for eescreen.com service. If you want to receive payments as a Screen Owner, you also need to create Stripe payment service account, which is attached to your eescreen.com account.

There are few rules you must follow when you create and use your account

You need to use your real name and accurate personal information. Impersonating another person or business is not acceptable.
You must be at least 18 years old to use our services.
A separate public name field that can be used for your business name or nickname. Do not use a name that is offensive, inappropriate or copyrighted by someone else.
Your account is only for your personal use. Do not use another member's account, share your account to anyone else, or transfer your account to another person or entity.
You are responsible for all activity on your account, so keep your password secure, especially if the account contains your billing information.

Role of eescreen.com

You understand and agree that EESCREEN is only a platform for screen hosting and campaign buying. We are not a party of any agreements between advertisers and screen Owners. Screen Owners and advertisers are in a business relationship between each others and our eescreen.com service is offering provision based services for Screen Owners.

We do not have full control of Owners or their devices, so we do not guarantee refunds. Users are completely responsible for their own screens for advertisers and possible refunds. We do not pre-screen or endorse user content, so we take no responsibility for the user content.

Even our site contains help pages, users are solely responsible for determining how laws apply to their eescreen.com service usage. We are not a party in any possible legal disputes between users, or between a user and any other authority or third party.

If we see any behaviour or content violating our Terms or policies, we may terminate the user account or remove the content. If you notice any behaviour or content that violates our Terms, let us know.

Content and Copyright

Any content you post to eescreen.com service is later referred as "Your Content", including public name, screen name, description, pricing, campaign name, uploaded images, feedback, etc.

You are solely responsible for Your Content. You warrant that you have all necessary licenses, rights and permissions to use Your Content in eescreen.com service, without us needing any permissions or license payments. Any violations of any third party's rights are on your responsibility.

Our policy is to not approve any inappropriate, offensive, abusive, vulgar, false or misleading Content. If we find one, we can remove the content and shut down your account. You are solely responsible for Your Content to meet our policies. As a Screen Owner, you also have responsibility for the content you approve from advertisers.

You remain any legal rights to Your Content, and we do not claim it. You grant us permissions to use Your Content in our service and also for our marketing. You grant us rights to make changes, edit, translate, format or delete any User Content, for example for marketing purposes on various media.

Payments, taxes and refunds

All our payments and VAT related matters are handled by Stripe service.

EeScreen provision is taken from the payments received by the Screen Owner and we do not charge advertisers at all. We are not in any kind of business relationship with advertisers. Screen Owner is solely responsible for possible refunds for the advertisers.

EeScreen is not giving any accounting or tax related consulting. We are not responsible for any possible instructions or information located on our website related to accounting or taxes. It is completely on your responsibility to verify all payment, earning, accounting and tax rules and laws related to your business.

Any advertisement payment or requesting payment outside of the eescreen.com service is prohibited. Doing so is breaching these Terms and therefore you are accepting all risks and responsibilities for such a payment.

Disclaimer and legal disputes

Our service is provided "as is" and "as available". Your use of eescreen.com service is at your own risk, without any warranties of any kind. We do not give any warranty or representation of reliability, quality, availability or security of eescreen.com service or screens hosted using it. Under no circumstances shall Eeku Oy or its affiliates, partners or workers be liable for any direct or indirect damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the eescreen.com website, even if we or our authorized representative have been notified orally or in writing of the possibility of such damage.

By using our service, you agree to release Us (Eeku Oy or any person associated with Eeku Oy) from any kind of claims, demands or damages related to our service. This does not affect to any laws or warranties which cannot be either limited or excluded by applicable law.

Eeku Oy and eeScreen is based in Oulu, Finland, so these terms and conditions are governed by and construed in accordance with the laws of Finland and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

Changes to the terms

We reserve the right to revise these Terms at any time without notice. When we revise the Terms, we will update "Last updated" date at the top of these Terms and we also notify our registered users of the change.

If you disagree with the changed Terms, you should stop using our service, but you have to take care of your obligations for possible customers which have already paid for you. For example, you can continue hosting already paid advertisements, but change your screen settings to not accept any new advertisements. If you continue using our services, it will be taken as an acceptance of the changed Terms.
